Closing down business doesn''t mean limited company contractors can just escape IR35 liability, says an expert.

Kate Cottrell, writing for Freelance UK, says if a contractor carries on providing services to the same client but through a new company, HM Revenue & Customs can look into the full relationship history.

The MD says closing a company "doesn''t give immunity from IR35" and could even "trigger an investigation".

She warns that if a contractor closes a company to avoid "the correct treatment of a contract under the IR35 legislation", then there could be very serious consequences under tax avoidance/evasion regulations.

IR35 legislation was introduced in 1999 to clamp down on using middle men for tax purposes.
